By now you have probably seen the notice indicating that the upper gate at Skyline Mountain Resort (SMR) is operational again.  This is the gate on Birch Creek Road through which Legacy Mountain lot owners are expected to pass in order to get to their lot.  It is an electronic gate which must be lowered beneath the ground to permit vehicles to enter or exit.  If you already have a gate card issued by the SMR office, that card should enable you to lower the gate and enter.  If you do not have such a card, you will need to contact the SMR office and pay the required fee. 
SMR has erected a booth adjacent to the gate on the entry side.  For the foreseeable future, they plan to have a gate control operator stationed inside this booth during daytime hours.  This person will be responsible for assisting owners and guests who have a legitimate reason to enter the gate and to turn away unauthorized persons who are not owners or their guests.  The former option which allowed guests to notify you of their arrival by using a telephone device located at the gate is not available at this time. 
To facilitate entry of authorized guests, SMR has requested that we provide them with a current list of Legacy Mountain lot owners and their telephone numbers so that the gate control operator can contact you via telephone if one of your guests arrives at the gate and announces that they are enroute to your lot.  However, we do not plan to provide SMR with your contact information unless you give us permission to do so.  If we do not receive your approval, we will not release your information.  Therefore, please designate your choice by marking an “X” next to one of the two options listed at the bottom of this page.
Kim Hansen, the SMR Manager, has assured us that they will not sell, give away, or otherwise distribute any information regarding the names or contact information on the list of owners we provide them.
Please use extra care when entering or exiting the gate.  Go slow, and do not attempt to pass through unless the traffic light is green and the gate is down all the way.  Only one vehicle should pass through at a time.  Be sure to avoid hitting the gate!  SMR plans to hold drivers financially responsible if they damage the gate.

February 3rd Letter Mailed to All Members

In a series of meetings during the past year, the board of directors of the Legacy Mountain HOA adopted a schedule of fines and penalties for violating the association's Covenants, Conditions, and Restrictions (CC&R's) or the accompanying General Rules.  The CC&R's and the accompanying Rules were adopted by a vote of more than two-thirds of the association lot owners in 2017.  Copies of both documents are posted on the HOA's website at legacymountainhoa.com.
 
The purpose of this letter is to inform all lot owners of the various types of violations that are subject to fine or penalty and the associated amount.  For your information, a copy of the schedule of fines and penalties is enclosed.  The document includes information about the various penalties such as interest charged on unpaid assessments.  The board intends to enforce each type of offense.
 
One violation involves initiating construction or major excavation activities (e.g., installing a driveway) without prior approval of the Architectural Review Committee.  The documents section of the HOA's website includes a detailed list summarizing the restrictions regarding such activities.  Violation of some construction restrictions may also be subject to a fine levied by the Sanpete County Planning and Zoning Department.  Any fines assessed by the County would be above and beyond those assessed by the HOA.
 
The CC&R's and the accompanying General Rules also prohibit lot owners who do not have a cabin from parking a camp trailer, mobile home, or motor home on their lot even for a short period of time.  However, lot owners who have an active building permit issued by Sanpete County are allowed to keep a camp trailer, mobile home or motor home on their lot during the active construction time period as long as they comply with the County's restrictions.
 
The fine schedule also includes fines for violating fire restrictions, igniting fireworks, or shooting a firearm within the boundaries fo the Legacy Mountain development.  The purpose of these restrictions is to minimize danger to life and property and to promote the safety of all lot owners and their guests.
 
Another violation refers to the disposal of unauthorized material in garbage dumpsters provided for the use of all lot owners.  Dumpsters sponsored by the HOA are provided for the disposal of household garbage only.  Construction materials, mattresses, furniture or landscape waste, etc. should not be deposited in these community dumpsters.  Instead, such unauthorized materials should be taken to the County landfill located about 10 miles South of Mt. Pleasant on Highway 89.  Owners engaged in active construction projects are expected to maintain a private dumpster on their lot for depositing construction waste materials.  The remaining fines relate to nuisance restrictions which helps us maintain the serenity and beauty of our mountain community.  We respectfully request your cooperation in abiding by the restrictions specified in the 
CC&R's and General Rules.

Electronic Gate

The card costs are as follows:
 *Cards 1 & 2 are free for new members (only SMR & Legacy Mountain members)
 *Cards 3, 4, & 5 will cost $8.00 + tax
 *Card 6 will cost $20.00 + tax
 *Card 7 will cost $40.00 + tax
 *Card 8 will cost $80.00 + tax
 *Replacement cards will be $8.00 + tax
 *Clickers (remote control) will be available and count as a card and will cost $75.00 + tax
 *Contractor clickers & non-member clickers will cost $200.00 + tax
 *Contractor gate cards will cost $100.00 + tax (they need to check in every 3 months to stay active)
